PRIVACY POLICY

1. The party responsible for data processing

By accessing and using this Website, and/or communicating electronically with RGVA, personal data of each User is collected and handled. These data shall be governed by this Privacy Policy. All capitalized terms of this Privacy Policy shall have the meaning set forth in the Terms of Use of this Website (Legal Warning), unless otherwise expressly stated in this Privacy Policy.

The professional company RAMOS GARCÍA VALLÉS, S.L.P., duly identified in the Legal Warning of this Website, is responsible for the processing of the personal data provided by the User when accessing and using the Website and its applications.

RGVA complies with Regulation (EU) 2016/679 of the European Parliament and Council of April 27th 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data; with Organic Law 15/1999 of December 13th on the Protection of Personal Data (hereinafter, “LOPD”); with Royal Decree 1720/2007 of  December 21st, which approves the Regulation for the development of said Organic Law and with other regulations in force and applicable at all times, ensuring the correct use and processing of the User’s personal data.

Also, RGVA hereby informs that it complies with Law 34/2002 of July 11th, on Information Society Services and E-Commerce and it will request the consent of the User for the handling of his/her email for commercial purposes at all times.

2. Detailed information of data handling on behalf of RGVA (activity record)

The data will be kept for the time indicated in the table above, i.e. as long as there are contractual obligations arising from the services or content requested by the Users and, subsequently, until the extinction of legal, contractual or deontological responsibilities that require them to be kept (e.g., until the extinction of the responsibility arising from data protection regulations or cybersecurity).

In the event that data is processed in order to forward our Newsletter, it may be kept as long as the User does not object to receiving information by any of the existing -free and simple- means that are made available.

By checking the acceptance box on each Form from where personal data is collected, you expressly, freely, specifically and unequivocally consent to the processing of your personal data for the purposes indicated. Likewise, you may at any time revoke the previous consent, as well as use your rights of access, rectification, cancellation, limitation, opposition, suppression and portability, by sending a written communication to the registered office of RGVA, located at C/ Balmes, nº 76, 4º-1ª, Barcelona (08007), or by sending an e-mail to the following address: rgva@rgva.es, always with prior ID.

All data requested as mandatory in the Website forms (fields marked with an asterisk) are necessary for RGVA to process them for the purpose stated in each case. The lack of any of this information will result in the impossibility for RGVA to process the User’s request. In any case, the User is responsible for the accuracy of the data provided and is responsible to inform to RGVA of the changes that may occur. RGVA reserves the right to reject communications that have provided false or inaccurate data.

3. Communications

The data shall not be communicated to third parties except, where appropriate, to competent authorities in the compliance of their duties. As an exception, the Website may use third party cookies in accordance with the Cookie Policy and the User’s consent.

Likewise, RGVA informs you that, in compliance with the provisions of the applicable regulations in force, your data may be communicated to (i) public offices with jurisdiction in the Firm’s activity sector and Courts, (ii) State security forces and entities, (iii) bank or financial entities (when required for the collection or payment of the services offered), and (iv) other professionals in the legal sector (when necessary to provide the services entrusted).

4. Exercise of rights

RGVA informs you that you are entitled to the following rights and that you can use them as follows:

  • ACCESS right to your personal data, to know whether or not RGVA is processing your personal data.
  • RECTIFICATION right of any inaccurate personal data.
  • DELETION right of your personal data or “right to oblivion“, when, amongst other reasons, the data is no longer necessary for the purposes for which they were collected.
  • LIMITATION right of the processing of your personal data, when the accuracy, legality or necessity of the processing of the data is doubtful, in which case we will only keep them for the exercise or defence of claims.
  • PORTABILITY right of your personal data, in a structured format, of common use and mechanical reading, to be transmitted to another data controller.
  • OPPOSITION right to the handling of your personal data, when the legal base that allows us to handle such data is the legitimate interest. For these purposes, we will stop processing your data unless we have an overriding legitimate interest or for the formulation, exercise or defence of claims.
  • The right to REVOKE your consent at any time.

The aforementioned rights may be exercised at any time and free of charge, by sending a written communication enclosing a photocopy of the DNI or equivalent identification document to the legal address of RGVA, located at C/ Balmes, nº 76, 4º-1ª, Barcelona (08007) or by sending an e-mail to the following address: rgva@rgva.es, always with prior ID.

We also inform you that you have the right to file a CLAIM before the Spanish Data Protection Agency if you consider that there has been a breach of data protection legislation with regard to the processing of your personal data.

5. Safety measures

RGVA implements the security levels required by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of data, appropriate to the data type being processed at any given time. However, technical security within the Internet is not impregnable and there may be fraudulent actions by third parties, although RGVA puts all possible means at its disposal to prevent such actions.

6. Minors

Minors may not use the services available through the Website without the prior authorization of their parents, guardians or legal representatives, who will be solely responsible for all acts performed through the Website by minors under their care, including filling out the forms with the personal data of such minors and checking the boxes that accompany them.
